Removal of elected governors in maintained schools

On 30 March 2017 regulations were laid to enable governing bodies of maintained schools to remove elected governors where there are serious or repeated conduct issues.  These powers will come into force from September 2017.

Ministers have decided that removal as an elected governor should lead to a five year disqualification from any school (rather than an indefinite ban).

The Department for Education has confirmed that it will set out clear expectations on the use of the power in guidance, rather than regulations, and that there will be an appeals process.  The draft guidance will be available in due course.

The statutory instrument and explanatory note are available here.
