Health and safety is an area that can cause our members a great deal of concern, especially when defining whether responsibility for an accident lies with the head teacher or employer. 

We set out the frequently asked questions school leaders get in contact with us about on this tough topic. Many of the questions don’t have clear ‘yes’ or ‘no’ answers, but instead, they refer to the need for a head teacher to decide based on their professional judgement. In these instances, we look at whether the decision you should take is reasonable, balanced and proportionate. 

The advice is based on health and safety regulations. However, when making any health and safety decisions, it’s important that you also have regard to any policy or procedure that the employer may have in place.
