The main points to consider are:-
It is not illegal for photographs of children to be taken in school.
Photographs taken for personal use do not breach the Data Protection Act.
Schools are free to determine their own policies with regard to parent/carers taking photographs at school events.
As a minimum requirement, all parents/carers will need to know that their children may be photographed if the school allows photographs. This will allow parents/carers of vulnerable children to discuss their situation with the school.
The NAHT takes the view that schools should formulate their own policies in line with national/local guidelines, whether or not it allows photographs at school events. This policy will need to be communicated to parents/carers and approved by the Governing Body. The NAHT will support members in the unlikely event that they are subject to a complaint as the result of any decision taken on this subject.
