New school governance regulations

The School Governance (Roles, Procedures and Allowances) (England) Regulations 2013 come into force on 1 of September 2013 and simplify and replace the provisions of three previous sets of regulations[1].

New provisions in these regulations:

  • Introduce three core functions on which governing bodies should focus:  

    • (a) Ensuring that the vision, ethos and strategic direction of the school are clearly defined;

    • (b) Ensuring that the head teacher performs his or her responsibilities for the educational performance of the school; and

    • (c) Ensuring the sound, proper and effective use of the school’s financial resources

  • Place a new obligation on governing bodies to have regards to advice from the clerk to the governing body as to the nature of that body’s functions.

  • Simplify the requirements in relation to setting the chair and vice chair’s term of office and reduce the list to functions of the clerk to

    • (a) Attend meetings of the governing body and ensure minutes of the     proceedings are produced.

    • (b) Maintain a register of members of the governing body and of associate members and report any vacancies to the governing body; and

    • (c) Perform such other tasks as may be determined by the governing body from time to time.

  • Set out that the proceedings of a governing body are not invalidated by any person not having received written notice or an agenda for the meeting.

  • Allow for alternative arrangements for governors to participate or vote at meetings including but not limited to telephone or video conference.

  • Provide more flexibility for governing bodies to delegate functions to a committee or a governor or the head teacher where the matter does not directly concern the head teacher.

  • Apply these regulations to governing bodies of federations and make it clear that a governor employed at a federated school is not eligible to be chair or vice chair of the governing body of that federation.
