A011 Suspension Guidance for Managers

The suspension of an employee is widely regarded as a neutral act but it is not as it can have such a serious impact on an employee that it should not be carried out without very careful consideration of the circumstances and the possible alternatives. Although not a neutral act suspension is not a disciplinary sanction.

This is advice for members from NAHT Assure on how to deal with suspension of employees.

A009 Fixed-term and temporary employees

The flexible appointment of teachers and other staff to cover the different situations that a school faces is an important management tool. However, the introduction of legislation to cover the employment of staff on fixed term and temporary contracts has meant that schools now have to be very clear in the reasoning for the use of such contracts to employ staff.
This guidance is intended to identify good practice relating to the use of fixed term, temporary contracts.

This Disciplinary Procedure is separate and distinct from Competence/capability and Sickness Absence Management Procedures. This procedure should be used where staff have wilfully or deliberately refused to perform their duties in a satisfactory manner, or have committed an act of misconduct. Poor performance due to a lack of skill or ability and suspension/dismissal on health grounds are not regarded as disciplinary matters.

Use of SIPs for Performance Management

There is currently some confusion as to the role of the School Improvement Partner (SIP) in relation to Head Teacher performance management (PM). Regulations put in place under the previous government specify that the governing body must take advice from an external adviser when undertaking performance management of the head teacher. All local authorities were required to put in place SIPs and, when these were appointed, the governing body had to use the SIP as the external adviser.

Advice for completing CRB Disclosure form

The CRB has published new guidance to help with the completion of the CRB application form. The guidance is split into two separate guides, one for applicants and one for Countersignatories, and both carefully explain the steps that must be taken to ensure that the application form is completed correctly, which should minimise errors and prevent application forms from being returned.
