Terms and conditions for NAHT Edge

Introduction

The following terms and conditions (the Conditions) govern your membership of NAHT Edge (NAHT Edge, we or our), including general terms and conditions of membership and use of the Services. By completing the application form for membership of NAHT Edge, you accept these Conditions (and any variation or amendment to them) in full.

These Conditions together with our privacy policy constitute the entire agreement between NAHT Edge and you. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by, or on behalf of, NAHT Edge which is not set out in the Conditions.

NAHT Edge shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirement, or which do not materially affect the nature or quality of the Services.

We may amend these Conditions in our absolute discretion at any time, and any revised versions will be effective immediately once published on naht.org.uk (the site).

Membership

  • Members of NAHT Edge will be entitled to the benefits and services of membership (see membership services section below)
  • Your membership will commence immediately on successful completion of your online application including submission of valid bank account details for payment of the subscription by direct debit  
  • If you apply for membership using a paper application form, your membership will commence once the application has been processed by NAHT Edge. Allow approximately seven working days for your application to be processed and for the membership details to be confirmed in writing
  • On commencement of your membership, you enter into an annual rolling contract with NAHT Edge for the membership services (see membership services section below) which are paid for by monthly subscription and collected by direct debit
  • Membership fees are payable by direct debit on or around the 28th of the month. If this date falls on a weekend or a bank holiday, payment will be taken on the nearest available banking day
  • Membership subscription rates will be published on the site and confirmed to you in writing before your NAHT Edge direct debit instruction becomes active 
  • NAHT Edge reserves the right to increase the membership fees provided that such fees cannot be increased more than once in any six month period. NAHT Edge will publish any such increase on the site 28 days before the proposed date of increase. NAHT Edge reserves the right to determine a lower level of subscription for any group for whom it feels appropriate to do so
  • Default on any payment due under these Conditions may result in the full balance of the membership fees becoming payable
  • Members whose subscription payments are more than three calendar months in arrears shall be deemed to have resigned their membership and shall not be entitled to any of the services or benefits of NAHT Edge
  • If you do not provide accurate bank details or your bank/building society does not authorise payment, your membership application will be deemed void. NAHT Edge will not accept any liability for costs incurred as a result of applications deemed void in this manner
  • On completing the online joining process, receipt of your application will be confirmed by email and your membership number will be included. Employment cover will be provided from that date for the role specified on joining but expressly excludes legal advice and representation on any pre-existing issue
  • NAHT Edge cannot be held responsible for identifying multiple membership applications from the same person if the online joining application process is completed more than once
  • It's the member’s responsibility to update NAHT Edge with any change of circumstances. If a member takes up a role which does not meet NAHT Edge eligibility criteria, NAHT Edge cannot be held responsible for providing employment cover for that role. If the member is part-way through proceedings when they become ineligible for NAHT Edge membership, NAHT Edge will continue to support the member until the case reaches a conclusion, subject to the member continuing to pay their NAHT Edge subscription  
  • On becoming a senior education leader, such as deputy head teacher or equivalent, an NAHT Edge member must leave membership or transfer to NAHT membership
  • On becoming ineligible for NAHT Edge membership due to retirement, an NAHT Edge member may apply for NAHT life membership if they are entitled to receive retirement benefits, usually at the age of 55. The benefits of this form of membership are provided on NAHT’s site 
  • NAHT Edge reserves the right to request further evidence to support your application and to withdraw membership if it finds that its eligibility criteria are not met. If you have any questions or require assistance, contact the member support team
  • You may cancel your membership in writing at any time by providing a minimum of 30 days' notice. You are liable for any membership fees due to cover your membership through the cancellation period
  • If you wish to exercise your right to cancel, inform us in writing by email to membersupport@nahtedge.org.uk. Include the words 'right to cancel' in the subject line
  • Any promotions and discounts are given at NAHT’s sole discretion and may be withdrawn by NAHT without notice 

Current promotions and offers

Terms and conditions for NAHT Edge member referral scheme

Member referral to NAHT and NAHT Edge is open to all full, professional

Applicants must provide the referring member’s membership number and name with their application.

By making a referral under this scheme, a member consents to us passing their name and membership number onto the person they are referring.

This promotion opens on 13 April 2017 and all applications with a referral must be received by NAHT by 11.59pm on 30 November 2017.

The existing NAHT member nominating the new member will be offered:

  • a £20 M&S voucher for every new member they refer who successfully joins NAHT or NAHT Edge 

The new member joining NAHT will be entitled to a £20 M&S voucher if joining on one of the following categories of NAHT membership and fully paid:

  • Head/Principal/Executive head
  • Deputy head/Vice principal
  • Assistant head
  • School business leader/bursar
  • Children’s centre leader 

The new member joining NAHT Edge will be entitled to a £20 Amazon voucher providing they are eligible for membership and fully paid. Please check eligibility at www.nahtedge.org.uk/Join/Eligibility.aspx

To qualify for a £20 M&S voucher the referring member must be fully paid up at the point the new member applies for membership, and have been in membership for a minimum of 30 days.

The existing NAHT Edge member nominating the new member will be offered:

  • a £20 Amazon voucher for every new member they refer who successfully joins NAHT Edge   

A new member who successfully joins under the member referral scheme must:

  • join NAHT or NAHT Edge, with a membership start date of no later than 1 January 2018
  • have made one payment, before vouchers are sent to either the referring member or the new member 

The offer is not open to members transferring between NAHT and NAHT Edge.

Applicants are not permitted to re-join NAHT or NAHT Edge under this scheme within a six-month period from leaving either NAHT or NAHT Edge.

Vouchers for eligible referrals will be distributed between one and three months after the new member’s first payment has been successfully made.

Late, incomplete or otherwise ineligible entries will not be eligible for the offer.

NAHT will not be liable for any voucher(s) that do not reach the members for reasons beyond our reasonable control.

No cash alternative is available and the offer is non-refundable and non-transferable. NAHT reserves the right to substitute the voucher for a gift of equivalent monetary value if this is necessary for reasons beyond its control.

Applicants are only eligible to apply for one promotional offer against their membership application during the period of the offer.

Entrants will be deemed to have accepted these terms and conditions and agreed to be bound by them when entering this promotion.

NAHT reserves the right to change the terms and conditions and/or to extend or suspend the campaign at any point.

NAHT reserves the right to void claims from NAHT officials, in bulk, deemed to be generated from NAHT events, exhibitions, regional or local branch meetings/events. The new member will still receive their vouchers.

Promotional offers on membership

  • To qualify for a discounted membership fee, a valid promotional code must be included and supplied on application
  • The offer is only valid on electronic applications via the URL specified on the promotional material 
  • Validity dates are provided on the promotional material and linked to the promotional code
  • Applicants must be eligible for membership as set out in NAHT Edge's constitution and rules
  • The promotional code entitles the applicant to an agreed discount off their membership fees – for the amount and time period specified on the promotional material
  • The discount will be applied to membership fees from the start date of joining and for the agreed time period relating to the promotional code. The discount will be applied proportionately throughout the membership period. For applicants who work 0.6 or less of a full-time equivalent post, the discount will be applied against the value of the part-time fee
  • Applicants are only eligible to apply for one promotional offer against their membership
  • Applicants are not permitted to rejoin via a promotional offer within a six-month period from leaving the association
  • Late, incomplete or otherwise ineligible applications will not be eligible for the discount. NAHT Edge will have sole discretion on whether an application is late, incomplete or otherwise ineligible 
  • No cash alternative is available and the discount is non-refundable and non-transferable
  • NAHT Edge reserves the right to change the terms and conditions, and/or extend or suspend the promotion at any point 

NAHT Aspire programme – NAHT Edge membership

  • To qualify for this exclusive offer, the applicant must work at an NAHT Aspire member school
  • The offer is only valid on electronic applications via the URL specified on the promotional materials
  • Validity dates are provided on the promotional materials and applicants must apply for membership within the dates provided
  • Applicants must be eligible for membership as set out in NAHT Edge's constitution and rules
  • The offer entitles the applicant to complimentary membership of NAHT Edge for twelve months. On renewal of membership, the standard membership fees will apply
  • Applicants are only eligible to apply for one promotional offer against their membership
  • Applicants are not permitted to rejoin via a promotional offer within a six-month period from leaving the association
  • Late, incomplete or otherwise ineligible applications will not be eligible for the discount. NAHT Edge will have sole discretion on whether an application is late, incomplete or otherwise ineligible 
  • No cash alternative is available and the discount is non-refundable and non-transferable
  • NAHT Edge reserves the right to change the terms and conditions, and/or extend or suspend the promotion at any point  

Membership services

Members of NAHT Edge will have access to the following Services:

  • education management and employment advice;
  • individual legal support and representation;
  • advice on pay, conditions and occupational pensions;
  • continuing professional development training courses;
  • career guidance material and information;
  • news updates and newsletter (available via email and on the site);
  • access to the site;
  • access to NAHT counselling and support line; and
  • personal accident insurance (subject to terms and conditions). 

Partners

NAHT Edge members will have access to additional Services. The Services will be provided by a number of carefully selected companies.

In the event that you choose to engage any of the partners direct, you enter into a commercial agreement with the respective partner and the delivery of said service will be subject to the terms and conditions of the respective partner. NAHT Edge shall not in any circumstances be liable or responsible for the failure by a partner to deliver their service and will not be liable or responsible for any loss or damages that may be incurred. 

Conferences, training courses and events

NAHT Edge members will have access to a range of conferences, training, courses and events. The cost of attendance and the supply of materials will be in addition to the membership fees, and the cost will be published in any advertisement.

Should a booking be cancelled by an NAHT Edge member, we reserve the right to make a charge based on a percentage of the delegate fee to cover any costs that we have incurred by that date.

Charges vary depending on when the cancellation is received:

  • Cancellation within 20 working days of the date will incur 25 per cent of the course fee
  • Cancellation within 10 working days of the date will incur 50 per cent of the course fee
  • Cancellation within five working days of the date will incur 75 per cent of the course fee
  • Cancellation within two working days of the date will incur 100 per cent of the course fee 

Bookings can only be cancelled in writing by email to events@nahtedge.org.uk. We reserve the right to cancel a training course if we receive insufficient bookings.

Use of the site

Terms of site use

These terms of use tell you the ways in which you may use the site. Use of the site includes accessing, browsing or registering.

Read these terms of use carefully before you start to use the site. We recommend that you print a copy of this for future reference.

By using the site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use the site.

The site uses cookies. By using the site or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our privacy policy.

Changes to these terms

We may revise these terms of use at any time by amending this page. Check this page from time to time to take note of any changes we have made as they are binding on you.

Changes to the site

We may update the site from time to time and change the content at any time. However, any of the content on the site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee the site or any content on it will be free from errors or omissions.

Accessing the site

We do not guarantee the site or any content on it will always be available or be uninterrupted. Access to the site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the site without notice. We will not be liable to you if for any reason the site is unavailable at any time or for any period. The site may routinely be unavailable for a short period between 4am and 5am due to server and software maintenance.

You are responsible for making all arrangements necessary for you to have access to the site. You are also responsible for ensuring all persons who access the site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them. 

Copyright and intellectual property rights

Unless otherwise stated, we are the owner or the licensee of all intellectual property rights on the site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy and download extracts of any page(s) from the site for your personal use, or stream audio and visual files. You may draw the attention of others within your organisation to content posted on the site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way. You must not use any illustrations; photographs; video or audio sequences; or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) must always be acknowledged as the author of content on the site.

If you print off, copy or download any part of the site in breach of these terms of use, your right to use the site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

You must not do the following:

  • republish material from the site (including republication on another site);
  • sell, rent or otherwise sub-license material from the site;
  • show any material from our restricted areas in public;
  • reproduce, duplicate, copy or otherwise exploit material on the site for a commercial purpose;
  • edit or otherwise modify any material on the site;
  • redistribute material from the site, except for content specifically and expressly made available for redistribution (for example, our press releases). Where content is specifically made available for redistribution, it may only be redistributed to NAHT Edge members if found within the members' area of the site; and
  • use any part of the content on the site for commercial purposes without obtaining a licence to do so from us or our licensors.

 

We reserve the right to restrict access to areas of the site, or indeed the whole site, at our discretion. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the site.

Acceptable use

You must not do the following:

  • use the site in any way or take any action that causes, or may cause, damage to the site or impairment of the performance, availability or accessibility of the site;
  • use the site in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
  • use the site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
  • conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the site without our express written consent;
  • access or otherwise interact with the site using any robot, spider or other automated means;
  • violate the directives set out in the robots.txt file for the site; or
  • use data collected from the site for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).

 

Registrations and accounts

You may register for an account by completing and submitting the registration form on the site and clicking on the verification link in the email sent to you.

You must notify us in writing immediately if you become aware of any unauthorised use of your account. You must not use any other person's account to access the site.

Usernames and passwords

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to a third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than yourself knows your user identification code or password, you must promptly notify us in writing by email to webteam@naht.org.uk.

You are responsible for any activity on the site arising out of any failure to keep your password confidential and may be held liable for any losses arising out of such a failure.

Cancellation and suspension of your web account

We may do the following at our sole discretion without notice or explanation:

  • suspend your account;
  • cancel your account; or
  • edit your account details.           

 

You may cancel your account at any point. You must notify us in writing by email to membersupport@nahtedge.org.uk.

Links

The links we provide for you on the site are for your information only. We have no control over the contents of those sites or resources. We do not accept responsibility or liability for content on external sites. We do not endorse any linked sites.

Your content: licences

You grant to us a non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.

Whenever you make use of a feature that allows you to upload content to the site (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files), or to make contact with other users of the site (including our blog), you must comply with the content standards set out in our acceptable use policy section (see below).

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you submit or upload to the site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the site (where applicable) a limited licence to use, store and copy that content, and to distribute and make it available to third parties.

We also have the right to disclose your identity to a third party who is claiming that any content posted or uploaded by you to the site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to a third party, for the content or accuracy of any content posted by you or any other user of the site.

We have the right to remove any posting you make on the site if, in our opinion, your post does not comply with the content standards set out in our acceptable use policy section (see below).

The views expressed by other users on the site do not represent our views or values. 

Acceptable use policy

Through accessing the site and using the services we provide, you warrant and represent that your content will comply with these terms of use.

Your content must not be illegal or unlawful, must not infringe any person's legal rights and must not be capable of giving rise to legal action against any person (in each case, in any jurisdiction and under any applicable law).

Your content, and the use of your content by us in accordance with these terms and conditions, must not do the following:

  • be libellous or maliciously false;
  • be obscene or indecent;
  • infringe any copyright, moral right, database right, trademark right, design right, right in passing off or other intellectual property right;
  • infringe any right of confidence, right of privacy or right under data protection legislation;
  • constitute negligent advice or contain any negligent statement;
  • constitute an incitement to commit a crime;
  • be in contempt of any court, or in breach of any court order;
  • be in breach of racial or religious hatred, or discrimination legislation;
  • be in breach of official secrets legislation;
  • be in breach of any contractual obligation owed to any person;
  • depict violence in an explicit, graphic or gratuitous manner;
  • be pornographic, lewd, suggestive or sexually explicit;
  • be untrue, false, inaccurate or misleading;
  • consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;
  • constitute spam; or
  • be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory.

Limitations of liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the site or any content on it whether express or implied.

We will not be liable to any user for any loss or damage whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the following:

  • use of, or inability to use, the site; or
  • use of, or reliance, on any content displayed on the site.

 

If you are a business user, we will not be liable for the following:

  • loss of profits, sales, business or revenue;
  • business interruption; 
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

 

If you are a consumer user, we only provide the site for domestic and private use. You agree not to use the site for any commercial or business purposes. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site, your downloading of any content on it or any site linked to it.

We assume no responsibility for the content of linked sites. Such links should not be interpreted as an endorsement. We will not be liable for any loss or damage that may arise from your use of them.

Viruses

We do not guarantee the site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the site. You should use your own virus protection software.

You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the site is stored, or any server, computer or database connected to the site. You must not attack the site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the site will cease immediately.

Supported browsers and mobile responsiveness

The break points agreed are for iPhone and iPad screen sizes as evidenced by NAHT access statistics from Google Analytics.

Supported browsers

Browsers supported by the site are as follows:

  • IE 7 – not supported
  • IE 8 – functional (however, some graphics may not display entirely as required)
  • IE 9 onwards – fully functional
  • Firefox – latest two versions
  • Safari – latest two versions
  • Chrome – latest two versions

 

Users may need to upgrade their browser version periodically to keep up to date. Browsers such as Firefox and Chrome release new updates regularly and normally update automatically.

Breaches of these terms and conditions

Without prejudice to our other rights under these terms and conditions, if you breach these terms of use in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may do the following:

  • send you one or more formal warnings;
  • delete, unpublish or edit any or all of your content (including without limitation blog posts);
  • temporarily suspend your access to the site;
  • permanently prohibit you from accessing the site;
  • block computers using your IP address from accessing the site;
  • contact any or all your internet service providers and request that they block your access to the site;
  • commence legal action against you whether for breach of contract or otherwise; and/or
  • suspend or delete your account on the site.

 

Where we suspend, prohibit or block your access to the site or part of the site, you must not take any action to circumvent such suspension, prohibition or blocking (including without limitation creating and/or using a different account). 

Law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with English law, and any disputes relating to them shall be subject to the exclusive jurisdiction of the courts of England.

Intellectual property and copyright

Intellectual property rights (patents, rights to inventions, copyright and related rights, trademarks, business names and domain names, rights in get-up, rights in goodwill or to sue for passing off, rights in designs, database rights, rights to use, rights in confidential information (including know-how) and any other intellectual property rights; in each case whether registered or unregistered and including all applications (or rights to apply) for, and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist, now or in the future, in any part of the world) in or arising out of, or in connection with, the Services shall be owned by NAHT Edge or partner(s) (where applicable).

You acknowledge that, in respect of any third party intellectual property rights, you have no authority to use any such intellectual property rights unless you have obtained a written licence from the relevant licensor (either NAHT or partners).

Data protection and use of personal data

NAHT is the data controller and data processor of any personal data you supply. The personal data you supply will be used to process your membership subscription. As a member of NAHT Edge, your data will be used for marketing, statistical and analytical purposes. You will receive membership communications and we will let you know about promotions. If you provide us with your email address, fax or SMS number then we may send information which may be of interest. In the event of a ballot, papers will be sent to your home address. In the absence of a home address, ballot papers will be sent to your work address.

We will only pass data to carefully selected third parties with your expressed consent.

If you wish to obtain a copy of your personal data held by us, write to Web Team, NAHT, 1 Heath Square, Boltro Road, Haywards Heath, West Sussex RH16 1BL. You may be charged a fee of £10 for this service. You may also be asked to provide proof of your identity and for information that might help to locate the data you are seeking.

Queries, feedback and complaints

We will respond to any complaint or query received within three working days. This may be an acknowledgement that we have received a complaint while further investigations are carried out. If you have any queries, comments or complaints about your subscription, contact webteam@nahtedge.org.uk
